What is an ITIN and what for?

The IRS issues the Individual Tax Identification Number (ITIN) as a tax processing number to ensure individuals, regardless of their immigration status, can comply with the U.S. tax laws. This nine-digit number is used exclusively for tax purposes and is assigned to those who do not meet the criteria to obtain a Social Security Number (SSN) but still have a federal tax filing or payment obligation.

The ITIN is crucial for individuals who need to file U.S. tax returns, pay taxes, or claim tax refunds, yet are ineligible for an SSN due to various reasons, including non-resident or resident alien status, or being a dependent or spouse of a U.S. citizen/resident alien. It also serves those who are a dependent or spouse of a non-resident alien visa holder. In addition to facilitating tax returns and payments, the ITIN allows individuals to comply with U.S. tax laws, thereby avoiding potential penalties for failing to file returns. It is important to note that having an ITIN does not change an individual’s immigration status or their right to work in the United States and does not make them eligible for Social Security benefits.

Does the ITIN gives me legal status?

No. The Individual Tax Identification Number (ITIN) is only used for federal tax reporting purposes and does not provide any form of legal status.

How do I apply for an ITIN?

Applications for an ITIN require submitting a completed Form W-7, IRS Application for Individual Taxpayer Identification Number, along with a federal tax return and proof of identity and foreign status to the IRS. Special documentation, such as a passport or birth certificate, may be required to verify one’s identity and foreign status.
